JOHOR, MALAYSIA — A 33-year-old Malaysian technician has been sentenced to 10 years in prison after accidentally trampling his girlfriend’s three-year-old daughter to death while caring for her in Kota Tinggi, Johor, in 2022.
Accident in the dark
According to Sin Chew Daily, the tragic incident occurred at around 3:30am on 20 July 2022. The man, Ahmad Ashraf, had gone to check on the girl and give her milk in a dark room.
In the darkness, he accidentally stepped on her chest, causing severe internal injuries and breathing difficulties.
When Ashraf turned on the light and realised what had happened, he immediately attempted first aid and rushed the child to hospital — but she succumbed to her injuries shortly after arrival.
Immediate surrender and cooperation
Ashraf, who weighed about 138 kilograms at the time of the incident, voluntarily surrendered to police the same day and was charged with manslaughter under Section 304(b) of Malaysia’s Penal Code.
He was sentenced on 30 October 2025, appearing visibly thinner and remorseful in court.
Judge: “A tragic accident, not an act of violence”
The court acknowledged that the incident was accidental and unintentional, noting there was no element of aggression or abuse.
In delivering the 10-year sentence, the judge considered Ashraf’s full cooperation, remorse, and sincere apology to the victim’s mother.
“The act was not born of malice but of misfortune,” the judge said, describing the case as a “deeply tragic accident.”
